The following is a binding contract to which the customer agrees implicitly by using any of the services provided by e-PhotoMemories.

e-PhotoMemories does not make any warranties expressed or implied as to the quality, satisfaction including the warrantees of merchantability and fitness for a particular purpose, or assumes any legal liability or responsibility for the accuracy, completeness or usefulness of any information product, service, process, or apparatus disclosed.

e-PhotoMemories does not assume any responsibility for any loss, physical, or personal damage, or any other type of damage from the use of its services. The customer submits material to e-PhotoMemories with the full understanding that e-PhotoMemories is not responsible for any damage to the material itself, or any damage resulting from the use of the material and its digital or other reproductions or alterations produced by e-PhotoMemories.

e-PhotoMemories accepts only legal material for reproduction, and will not in any case reproduce copyrighted material without the permission from the copyright owner to the extent of the knowledge of the employees of e-PhotoMemories. The customer accepts all responsibility for violating any copyright laws in submitting material for reproduction or other services without notifying e-PhotoMemories of the copyright nature of the material. The customer agrees not to hold e-PhotoMemories responsible for any violation, beyond incidental use, of national and international copyright laws without its knowledge.

e-PhotoMemories will not accept any material of explicit sexual nature, or other material intended for mature viewers for reproduction, and takes no responsibility for such material. e-PhotoMemories may choose to return the material (for a shipping and handling charge) or destroy such material at its discretion. e-PhotoMemories reserves the right to decide what material falls under these categories.

e-PhotoMemories assumes no responsibility whatsoever for any possible loss or damage incurred in shipping the material from or to the customer.

The customer agrees that in the event of any dispute, such a dispute will be settled in a Court of the State of Texas and will not exceed the amount paid to e-PhotoMemories for the service.
